Fair Labor Standards Act
The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, record keeping, and youth employment standards affecting employees in the private sector and in Federal, State, and Local governments.
Companies often mis-classify their employees as "exempt," or call them "managers" or "administrators," or even treat them as independent contractors as a way to avoid paying overtime. Other companies claim to pay overtime, but then pressure hourly employees to come to work early, stay late, work during lunch or do other work "off-the-clock."
Employees alleging violation of the FLSA can sue their employers to recover unpaid wages, unpaid overtime, liquidated damages and reasonable attorney fees and costs.
